The hours right after an accident are chaotic — but they're also when the evidence that decides your case is still fresh. Here's exactly what to prioritize.
1. Get medical attention — even if you 'feel fine'
Adrenaline masks injury. Soft-tissue damage and concussions often surface days later. A same-day medical record ties your injury to the accident; a delay hands the insurer an argument that something else caused it.
2. Document everything you can
- Photos of vehicles, the scene, road conditions, and visible injuries.
- Names and contact details of every witness.
- The other driver's insurance and license information.
- A written note of what happened while it's fresh in your memory.
3. Be careful what you say
A friendly adjuster may call within a day asking for a 'quick recorded statement.' You are not required to give one, and casual phrasing like 'I'm okay' can be used to minimize your claim later. Politely decline until you've spoken with an attorney.
Insurers move fast in the first 48 hours for a reason. You should too.
4. Call before you settle anything
Early lowball offers are common precisely because carriers know you're stressed and may not yet grasp the full extent of your injuries. A brief, free consultation costs you nothing and can preserve significant value.
