As an injured passenger you're generally covered by that policy regardless of which driver caused the crash. The key is documenting the trip and filing into the correct coverage tier.

A rideshare driver hit me while driving my own car. Who pays?

It depends on the driver's app status at that moment. App off: their personal policy. Waiting for a request: an intermediate tier. Trip accepted or passenger aboard: the large commercial policy. Insurers dispute app status precisely because so much money rides on it — the trip data settles it, and I know to demand it immediately.
